1. Membership 1.1. Your membership will begin on the day you join.
1.2. When paying by Direct Debit, an initial payment may be required to cover the period up to your first DD payment.
1.3. Your membership is personal to you. You cannot transfer it to another person.
1.4. If “De Souza Dojo” or the bank/building society makes a mistake with your direct debit payment you are guaranteed a full and immediate refund from your bank/building society.
2.1. You must pay a monthly membership which will be determined by your chosen membership package.
2.2. Monthly instalments will be due on the day you join and thereafter on the same day each calendar month or the next available working day by Direct Debit or recurring card payment.
2.3. We may change the amount of your monthly payments. If we do we will write to you at the email address you have given us 14 days before the changes take place.
2.4. Monthly fees are payable even if you do not use the centre.
3. Cancelling Your Membership
3.1. Memberships cannot be cancelled prior to the agreed contract length that you have signed up for and the last payment has been made. A contract may be cancelled once the final payment has been made; this requires 30 days notice in writing to De Souza Dojo (e-mail firstname.lastname@example.org). A confirmation letter will be sent back. The final payment will be taken when notice is given. Queries on cancelled memberships can only be dealt with when a copy of this letter is provided. 3.2. Should you break the contract prior to the agreed contract length, the whole remaining balance will become due immediately.
3A. Freezing Your Membership
3A.1 Memberships can be frozen up to 4 months in any 12 month period. This option can be used if you are away on holiday, business or work. One month notice must be given in writing to email@example.com
3A.2. Freezing memberships are at a reduced rate of £12 per month (price as of July 2017, subject to change)
3A.3. If you are injured and want to freeze your membership longer than 3A.1 allows, then please obtain a doctors note/certificate and email to firstname.lastname@example.org
3A.4. Months when memberships are frozen do not count towards your minimum months required in your contract.
4. Centre Rules
4.1. You must comply with the centre rules/etiquette which forms part of this agreement.
4.2. We may change the rules/etiquette at any time. We will post notice of any changes at the centre.
5. Changing the Agreement
5.1. We can change the agreement at any time. We will give you 14 day’s notice of this change in writing at the email address you have given us.
6.1. You are entitled to use the facilities available for your category of membership package.
6.2. You may have to pay additional charges to use certain other facilities/activities at the Centre. You can get a list of these from our reception points. We can change these prices at any time.
6.3. Before using any exercise equipment you must read and sign the Health Commitment Statement/Pre Activity Questionnaire and have a supervised induction session. We can refuse access to the centres facilities if we consider your health maybe adversely affected by the use of such facilities. In such circumstances you will be referred to our GP referral team.
6.4. Centre’s may open/close earlier during public holiday periods. Facilities may also close for occasional special events. Notices will be displayed in the centre in advance notifying customers of any changes. No refunds will be available for these periods.
6.5. We may change the centres opening times or withdraw any of the facilities at any time if we need them for events, tournaments, exhibitions or other special activities.
6.6. We may need to close a facility or part of it for repair/refurbishment on the grounds of health and safety or improving customer service. Fitness classes may also have to be cancelled due to unforeseen instructor unavailability. In the above circumstances we will use our best endeavours to: 6.6.1. Give as much notice as is reasonably practicable by displaying notices in the centre. 6.6.2. Arrange for alternative facilities during a period of closure.
6.7. Your membership does not give you priority over other users or guarantee the availability of facilities.
6.8. “De Souza Dojo” management reserve the right to change the activity programme. Prior notice will be given in the centre relating to activity cancellations or the introduction of new sessions.
6.9. Promotions do not apply to existing members.
7. Membership Cards
7.1. You must submit your membership card at respective reception points when accessing facilities; otherwise we will charge you the standard casual rate.
7.2. All members must have their photograph taken for identification purposes; this will be stored on “Mindbody” database. This information will solely be used by “De Souza Dojo” and will not be released to any third parties. 7.3. If you lose your membership card/wellness key we will charge a fee to replace it.
8. Junior Members and Children
8.1. If you are 16-17 (inclusive) your parent or guardian must sign this agreement on your behalf. By signing this agreement your parent or guardian agrees to be responsible for your behaviour and actions at all times and to pay us any amounts that are due on your behalf.
8.2. When you reach 18 your junior membership will end and you will automatically and immediately become a full adult member and sign a copy of this agreement.
8.3. Children aged 4 years up to and including 12 years will be on the Kids membership pricing options. As soon as a child reaches 13 years of age they will be transferred to the Teens membership pricing options.
9. Platinum & Gold Memberships - Adults
9.1 Private classes must be booked and taken within the month it has been paid for; it cannot be carried forward to another month.
9.2 Private classes cannot be transferred to another person.
10. Kalmalife Memberships
10.1 Massage or nail treatments must be booked and taken within the month it has been paid for; they cannot be carried forward to another month.
10.2 Massage or nail treatments cannot be transferred to another person.
Hire Terms & Conditions
1. Hire of Facilities
1.1 Hire of facilities will be booked by completing and signing a hire form. It will only be confirmed once payment in advance or a deposit has been made.
1.2 Bookings made more than 4 weeks in advance will be required to pay a non refundable deposit.
1.3 Hire of facilities must be completely paid for no later than at least 4 weeks before hire takes place.
1.4 Should payment for the hire of facilities not be received 4 weeks before the hire takes place your booking may be cancelled.
2. Cancellation of Hire of Facilities
2.1 Bookings which are cancelled with less than 4 weeks notice will incur the full payment.
2.2 Bookings which are cancelled with more than 4 weeks notice but less than 8 weeks will be charged at 50%.
2.3 Bookings which are cancelled with more than 8 weeks notice will not incur any additional fees to the deposit already paid.
2.4 We reserve the right to cancel any booking at the last minute in the case of an emergency, booking fees will then be refunded.
